These Terms of Service ("Terms") govern your access to and use of Carded, a browser-based ID age-verification tool ("the Service"). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. What Carded does
Carded reads the barcode on a government-issued ID and displays the encoded data along with an age calculation and expiration check. It also runs automated barcode-integrity checks on that data and shows a "checks passed" or "review this ID" indicator to help staff spot suspicious IDs. It is a tool to assist trained staff in making age-verification decisions quickly.
The integrity checks look only at the information encoded in the barcode. They confirm things such as whether the barcode follows the AAMVA standard used by North American motor-vehicle agencies, whether its six-digit issuer number is a recognized jurisdiction that matches the state shown on the ID, whether required fields are present, and whether the encoded dates (such as date of birth, issue, expiration, and any "under 21" date) are internally consistent. When something is missing, malformed, or inconsistent, Carded flags the ID for manual review.
2. Your responsibilities
- You are responsible for complying with all laws and regulations that apply to your business, including age-restricted sales laws and any rules governing the scanning, recording, or retention of information from customers' IDs.
- You are responsible for training your staff to exercise independent judgment and not to rely solely on the Service. Carded's age, expiration, and barcode-integrity results are decision aids only; your staff must still inspect the physical document and use their own judgment before accepting or refusing an ID.
- You are responsible for any records you export from the Service and for handling them lawfully.
3. Acceptable use
You agree not to misuse the Service, including by using it for any unlawful purpose, attempting to interfere with or disrupt it, reverse-engineering it other than as permitted by law, or using it to collect or retain personal information in violation of applicable law.
4. Subscriptions and billing
Carded is offered as a paid subscription, sold per location, with plans that differ by how many devices may use the Service at once. Current plans, prices, billing intervals (weekly, monthly, or annual), and any free-trial length are shown at the point of purchase.
Subscriptions are handled by our payment processor, Stripe. Where a free trial is offered, your paid subscription begins automatically at the end of the trial unless you cancel before it ends, and your payment method is charged then. Subscriptions renew automatically each billing period until cancelled. You can cancel at any time from the billing portal in the app; cancellation stops future renewals and takes effect at the end of your current period. Fees are billed in advance and, except where required by law, are non-refundable, including for partial periods. We may change plan pricing on a going-forward basis with reasonable notice.
You are responsible for keeping your subscription email and any device access code confidential, and for the devices you authorize on your plan. Anyone you give them to may be able to activate a device on your subscription up to your plan's device limit.
We also offer optional add-ons, such as DeliveryPro, which unlock additional features for an extra recurring fee shown at the point of purchase. Add-ons are billed on their own recurring interval alongside your plan, renew automatically until cancelled, and can be cancelled at any time from the billing portal; the same billing and refund terms above apply. DeliveryPro lets you capture the recipient's name, signature, a not-visibly-intoxicated confirmation, an optional photo, and the delivery address at delivery. These delivery records are created and stored on your device, and you are solely responsible for reviewing whether they meet the delivery, record-keeping, and reporting requirements that apply to your business and jurisdiction, and for retaining and handling them lawfully. The Service is a tool to help you capture these records; it does not constitute legal advice or guarantee compliance with any state's delivery rules.
5. Intellectual property
The Service, including its software, design, and branding, is owned by Carded and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service for your business. You may not copy, resell, or create derivative works from the Service without our permission.
6. Disclaimer of warranties
The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that it will correctly read every ID. While the Service performs automated barcode-integrity checks, we make no representation or warranty that it detects fraudulent, forged, or altered documents, that a "checks passed" result means an ID is authentic, or that a flagged result means an ID is not genuine; those checks are provided only as an aid to your own review and are not a substitute for inspecting the physical ID.
7. Limitation of liability
To the fullest extent permitted by law, Carded and its owners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost profits, fines, penalties, or loss of licenses, arising out of or related to your use of (or inability to use) the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us for the Service in the twelve months before the claim.
8. Indemnification
You agree to indemnify and hold harmless Carded from any claims, damages, or expenses arising out of your use of the Service, your export or handling of records, or your violation of these Terms or applicable law.
9. Changes to the Service and Terms
We may modify or discontinue the Service, and we may update these Terms, at any time. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
10. Governing law
These Terms are governed by the laws of the jurisdiction in which Carded is established, without regard to conflict-of-law rules. Any disputes will be handled in the courts of that jurisdiction.
